Educación a Distancia Latinoamérica, LLC ("EDLatam"):
We, the Online School — meaning Educación a Distancia Latinoamérica, LLC, doing business as EDLatam (also referred in this document as “we,” “us,” “our,” and “EDLatam”) — take very seriously the respect and protection of your privacy and security. We also recognize the importance of protecting your privacy and the information that you share with us, and we are committed to fair practices that protect this information.
2. Channels and Methods used for the Collection of Information
The information that we collect from you through this website will vary depending upon how you use the website and what information you choose to provide to us.
When you interact with the Service and in connection with our events, publications, blogs and sales and marketing activities, we collect information that alone or in combination with other information could be used to identify you (“Personal Data”), as described below.
A. Information You Provide or Give Us Directly
If you contact us via e-mail or submit an online request for information, we will collect the information that you provide to us in your e-mail message or request, including your name, phone number, contact information, email address, demographic information (such as your occupation), as well as any other information you provide to us in our website forms, such as questions or comments that you may submit.
We may also collect data from you including without limitation when you attend one of our online events, during phone calls with service representatives, or when you contact student support.
When you enroll in one of our courses of study programs, we also collect data related to your payment method and if applicable, of the person who actually made the payment. Although we do not usually process your tuition and subscription payments directly, since we use external payment gateways such as PayPal or similar providers, we store information about you or the person who made the payment, including but not limited to: name, billing address, email address, credit card type and amount paid. We do not store personal credit or debit card information in our system such as credit card numbers, security pins or codes, name on the card and/or expiration date. This information is not available in our system and is not part of your personal information profile.
As an enrolled student in any of our courses or study programs, we also collect personal information you provide to us when filling your Student Profile. This information may include your full name, country, shipping address, home phone, mobile phone, date of birth, gender (male or female), as well as other information related to the course you are enrolled or subscribed to. For example in the case of a photography course, we may ask you to provide us with information related to your photography equipment, camera brand and type, your skills as a photographer, since what age you started taking photographs, etc. This information is used by EDLatam, our Mentors, Tutors and staff in order to provide you with a better and more efficient Service.
We also collect and store the files you upload, download, or access with EDLatam Service (“Files”) and we may associate all or a portion of these files with your personal profile. As a student, all files uploaded as part of your Course Projects, such as images, photos, essays, presentations, documents, personal photos, PDF files, profile pictures, etc. are stored as part of your personal student profile.
B. Information We Get from Other Service Providers of EDLatam
We may also receive Personal Information (for example your email address and/or name) from other entities that provide us with advertising services, such as Facebook, Google+, Google Adwords, Instagram, etc. obtained when you interact with our messages, ads or publications. This data may be combined with other information we collect to become part of your personal information.
C. Information Automatically Collected when visiting our Websites or Services
We may collect information about the devices you are using to access our website and learning platform. As an example, we may collect statistical information such as: type of device, operating system used by your device, application information, unique device identifiers and crash data. The type of information we collect depends on the type of device used and its settings. This information is not generally part of your personal information and is only used by EDLatam in order to obtain more knowledgable information about our users in general as described below in the following sections.
D. Information you upload using our services as a Student
We automatically collect information from the files and content you upload while using the Service, including but not limited to files and images you upload, projects, evaluations, exams and photos you submit, as well as any comments related to this files or projects. For example, in the case of images and photos, we collect information about copy rights, aperture, speed, date, type of camera, type of lens, etc. (known as EXIF data).
If your course includes a Mentor of Tutor, we also store your questions and answers related to your mentoring program in order to keep track of your advancement and maintain your tutoring sessions history.
E. Other Information you upload using our services
When you upload files, projects, images, photos or any other kind of materials to our platform or websites that may include other information related to you or the persons mentioned in such documents, we do not collect any Special Categories of Personal Data about you or anyone else, (this includes details about your race or ethnicity, religious or philosophical beliefs, sex life, sexual orientation, political opinions, trade union membership, information about your health and genetic and biometric data). Nor do we collect any information about criminal convictions and offenses. If you use any of these types of personal data with our service (e.g. in the content you upload), we will not be able to tell and/or extract such information as part of your profile. We will treat all of this additional personal data included in files and content uploaded as ordinary and non classified personal data.
Changing, updating or Deleting Your Information
As an enrolled student or user, you can modify your personal information in your student profile and in your internal Social Network profile. Just log into your account and edit your information. Previous information stored in your profile will be automatically deleted and forgotten.
If as an enrolled student you request us to delete all your personal information, you will loose all history as a member of our school, including any certifications and accomplishments. In this case, is better to request us to make your account inactive.
3. Other non Personal Information we Collect for Statistical Purposes
We may automatically log information about you and your computer, either directly in our website, or though external service providers such as Google Analytics. For example, when you interact with us, we automatically receive and store certain types of information, such as the content you view, the date and time that you view this content, the products you purchase, or your location information associated with the IP address of your computer or device. We can detect your computer operating system type, browser type, browser language, pages you viewed on our website, and how long you spend on each page. We use the information we collect to serve you more relevant advertisements or content (referred to as “Retargeting”), related to the courses or products you show interest in. This is statistical information used to monitor and design more efficient marketing strategies based on the usage of our website and/or Services. This information does not include personal information and is not stored individually on your personal profile.
As you browse through our website at www.edlatam.com, advertising cookies will be placed on your computer browser so that we can understand what you are interested in. Our display advertising partners, AdRoll, Twitter, Facebook and Google AdWords then enable us to present you with retargeting advertising on other sites based on your previous interaction with EDLatam. The techniques our partners employ do not collect personal information such as your name, email address, postal address or telephone number. You can visit the page http://www.adroll.com/about/privacy to opt out of AdRoll and their partners' targeted advertising, or you can modify your advertising preferences in your personal profiles at Facebook or Google+.
Our site is coded with a special tracking pixel that will trigger our adds when you visit your Facebook page. If you want to opt-out of this feature, visit your Facebook settings.
5. Use of your Personal Information
We use your personal information for the following purposes to provide you with the quality of Service we believe you deserve.
1.- To operate, improve, maintain and deliver our products and services as a distance education school.
2.- To be able to provide to our users and registered students with the products and services they request based on our contractual relationship.
3.- To respond to questions, comments or tutor advise, requested by our students and to provide them with proper customer service.
4.- To send information including enrollment confirmations, invoices, due payment notices, account activation and deactivation notifications, technical notices, updates, security alerts, evaluations, digital certificates, and support and administrative messages. These communications are strictly necessary and you may not be able to opt out of them, while active as a student of EDLatam.
5.- To communicate system upgrades, platform functionality modifications, promotions, upcoming discounts, and other news about products and services offered by us.
6.- To protect, investigate, and deter against fraudulent, unauthorized, or illegal activity.
If you send us any questions or comments by e-mail, we will use your e-mail address to respond to your questions or comments. If you submit an online request for information, we will use your name and contact information to process your request and we will subscribe you to our monthly newsletter related to the subject you are interested in. You can opt out of any of our newsletters or publications at any time. All our emails include an unsubscribe button for you to opt out from any of our lists.
When you register a user account with edlatam.com, you will need to verify and activate your account, following the instructions you will receive by email. We will not send you any information until you confirm the activation of your account. Activating your account implies your consent to receive the information requested.
If you enroll in any of our courses, we will use your personal information provided in our registration forms to automatically register you as a student in our website. You will be provided with a username and password to access your course and the student interface. You will also need to activate your account by following the proper instrucciones we will deliver to your registered email account; you will not be able to access your course until you properly activate your account. You will also be automatically unsubscribed from any marketing or information lists, and will be subscribed to your particular course information list and you will receive, via e-mail, all information related to your course or courses. If you enroll in several courses, you will also be subscribed to each course information emailing list. You will also be enrolled in the Internal Social Network Group or Groups for students of each of your courses, so you can interact with other students enrolled in your course. While you stay as a registered and active student of a course, you will not be able to automatically opt out of your course list.
We do not share your information with any third parties not related to EDLatam and its affiliates. We do not share our subscribers, students, clients of friends information, so you can be sure you will not receive information from any other person or institution not related to us, as a result of you trusting your information to us.
Although we do not directly collect any of your financial information such as credit or debit card numbers, expiration dates and/or address or codes related to your form of payment, because we do all of our transactions via PayPal, we have a secure processing server when collecting any other information to ensure a high level of security for your personal information entered such as name, e-mail address, country of residence, date of birth, billing address, phone numbers, etc.
6. Access To Your Information
Maintaining information that is current, accurate, and complete allows us to make our website more useful and to provide our students, subscribers and members with better service. To that end, we encourage you to update your information from time to time.
If you are a registered student, you may review, edit and update your personal information inside your Student Profile, your Social Network Profile and inside your Course Projects page.
The security of your information is very important to us. We thus implement appropriate technical and organisational measures to help protect the security of your information.
We use industry standard security measures to protect any personal information that you may provide to us. However, no method of electronic transmission or storage is 100% secure, therefore we cannot guarantee that your submissions to our website, any content residing on our servers, or any transmissions from our server will be absolutely and completely secure.
Access to your personal information on our website, to the Course materials and other parts of your course materials, like consultations to your Tutor, online exams, files or projects, can only be accessed with a valid student number and/or login key (username and password). You are responsible for keeping your student number, login key, username and password, secret and confidential, and for notifying us if you believe that your student number, login key, username and/or password have been stolen or might otherwise be misused.
Your password protects your user account, so we encourage you to use a unique and strong password, limit access to your computer and browser, and log out after having used our Platform, Website or Service.
8. Disclosure and Our Legal Bases for Processing Your Personal Information
All your personal data is used by EDLatam, its subsidiaries and affiliates in order to provide the service you deserve. Each individual course may require additional information about yourself and your habits or preferences related to the particular course you enroll in. For example, enrolling in a photography course may prompt us to obtain from you information about your camera equipment and knowledge of photography.
Your personal information or any other information you provide us through e-mail and or our website information forms, will not be shared with third parties or sold to any businesses or organizations looking for databases in order to market other products or services without your authorization. Your information will only be used by EDLatam and its affiliates in order to provide your with the service offered by the course or courses in which you enroll.
In order to collect and/or use your personal information we have at least one of the following legal bases:
B. To register you as a student and to process your paid Enrollment to our Online School
Processing your information is necessary to provide your with the service implicit in any of our course or study programs. By enrolling in one or any of our courses, your authorize us to process all your personal information indefinitely or until you request us to inactivate your student account.
C. Active and Existing Customers or Students
If you have been our customer in the past, we may communicate with you via email, in order to inform you about products and services similar to the ones you showed interest in or you graduated from. Be aware that as a graduated student, you will have access to your studying materials, even after you finish your course. In order to provide you with this continuous Service, we need to maintain your personal information active.
D. Legitimate Interests
Processing your information is necessary for our legitimate interests or the legitimate interests of a third party, such as our course providers, considering those interests are not outweighed by your rights and interests. These legitimate interests may include the following:
- Delivering, developing and improving our student platform, Learning Management System (LMS), our Online School in general and our services and products.
- Ensuring that our website, platform, and infrastructure operate smoothly.
- Determining whether marketing campaigns are effective.
- Improving data security.
- Gaining insights from your behavior on our website in order to be able to offer you and third-party services and products with useful behavioral knowledge.
E. Legal Obligation
Processing of your information is necessary for compliance with our legal obligation which we are subject to you and our students (for example to provide you with invoices, student enrollment letters, course certificates, report to tax authorities, etc.)
If you are residing in a country that is a member State of the European Economic Area (For example: Spain, France, Switzerland) and therefore you are pursuant to applicable data privacy legislation, we shall make sure that you can exercise the following rights:

Please note that if such information also contains personal data about another person, we may not choose to include such data in our deliverables.
You have the right to be ‘forgotten’. All you have to do is ask and we will delete your information unless we have another legal reason to hold your personal information (such as a legal claim or a regulatory requirement).
You can ask us not to use your information for direct marketing purposes.

Accordingly, if we receive a request from you to exercise your right we are not obliged to address it in this way, since such a request should be forwarded to our customers instead (who would be the "controllers" under the EU Law).
We would be happy to spend the time and effort necessary to address any of your privacy concerns, however, if you believe that your rights have not been properly addressed you can file a complaint regarding our use of your information to the Data Protection Authority of your habitual residence or place of work.
10. Word Retention
We will retain your information, which may include general personal information, for as long as your account is active or as needed to provide you with our Services and study programs. If you wish to cancel your account or request that we no longer use your information to provide you services, you may delete your account. We may retain and use your information as necessary to comply with our legal obligations, resolve disputes, and enforce our agreements. Consistent with these requirements, we will try to delete your information quickly upon request. Please note, however, that there might be latency in deleting information from our servers and backed-up versions might exist after deletion. In addition, we do not delete from our servers files that you have in common with other users.
